We at SuTasty & ENC (“SuTasty & ENC”, “we”, “us”) value your privacy and want you to understand how we gather, utilize, and share information about you. This Privacy Policy explains how we collect data and what your rights are regarding your personal information.
Unless we link to a separate policy or specify otherwise, this Privacy Policy applies whenever you visit or use SuTasty & ENC websites, mobile applications, APIs, or related services (the “Services”). It also applies to potential clients for our business and corporate goods.
By using the Services, you accept the terms of this Privacy Policy. You should not use the Services unless you agree to this Privacy Policy or any other agreement that governs your use of the Services.
To complete your registration, you will provide your first and last name, email address, credit card information, billing address, and create a password. You are responsible for maintaining the confidentiality of your password and account. You are fully responsible for all activities that occur under your password or account. You are further responsible for any and all liability and/or damage resulting from your failure to maintain password confidentiality. It is important for you to protect against unauthorized access to your computer. Be sure to log off when you finish using a shared computer. You agree to immediately notify SuTasty & ENC Nutrition of any unauthorized use of your password or any breach of security. You also agree that SuTasty & ENC Nutrition cannot and will not be liable for any loss or damage arising from your failure to keep your password secure.

The Data We Collect:

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information.”

We collect Device Information using the following technologies:

When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information.
We collect certain data directly from you, such as information you enter yourself, data on your content consumption, and data from third-party platforms with which you connect to SuTasty & ENC. All data in this part is processed in the following ways: collecting, structuring, storing, changing, retrieving, encrypting, pseudonymizing, erasing, combining, and transferring.

We may collect different types of data from or about you depending on how you use the Services. Here are a few samples to help you comprehend the data we collect.
When you register an account and use the Services, even through a third-party platform, we collect any data you submit directly, including:

Student Payment Data If you make a purchase, we collect certain data about it (such as your name, billing address, and ZIP code) that is required to execute your order and may be kept for future orders. You must supply payment and billing information directly to our payment service providers, such as your name, credit card information, billing address, and ZIP code. We may also obtain limited information from payment service providers, such as the fact that you have a new card and its last four digits, in order to process payments. SuTasty & ENC does not collect or store sensitive cardholder data, such as complete credit card numbers or card authentication information, to ensure security.

Data About Your Accounts on Other Services We may collect certain information from your social media or other online accounts that are linked to your SuTasty & ENC account. If you log in to SuTasty & ENC through Facebook or another third-party platform or service, we will request your permission to access certain information from that other account. Depending on the platform or service, we may collect your name, profile image, account ID number, login email address, location, the physical location of your access devices, gender, birthday, and a list of friends or contacts.
These platforms and services make information available to us via their APIs. The information we get is determined on what you (via your privacy settings) or the platform or service choose to share with us.

Sweepstakes, Promotions, and Surveys We may offer you to take a survey or participate in a promotion (such as a contest, sweepstakes, or challenge) via the Services or a third-party platform. If you participate, we will collect and keep the information you give, including your name, email address, postal address, date of birth, and phone number. That data is subject to this Privacy Policy unless differently mentioned in the official promotion rules or another privacy policy. The information collected will be used to run the promotion or survey, including informing winners and providing prizes. To earn a reward, you may be needed to give us permission to publicly display some of your information (such as on a winner’s page). If we utilize a third-party platform to conduct a survey or promotion, the third party’s privacy policy will apply.

We use your information to react to you and investigate your query or complaint in accordance with this Privacy Policy.

How We Collect Data About You

We collect the data stated above using mechanisms such as cookies, web beacons, and other tracking technologies. Some of these technologies allow you to opt out of data collecting.

1. Cookies and Data Collection Tools:

We gather, store, and share data about your actions across websites, including SuTasty & ENC, using cookies, which are little text files stored in your browser. They allow us to remember information about your visits to SuTasty & ENC, such as your chosen language, and make the site more user-friendly. When you access and use the Services, SuTasty & ENC and service providers acting on our behalf (such as Google Analytics and third-party advertisers) use server log files as well as automated data collection tools such as cookies, tags, scripts, customized links, device or browser fingerprints, and web beacons (collectively “Data Collection Tools”). When you use the Services, these Data Collection Tools automatically track and collect specific System Data and Usage Data (as described in Section 1). 2. Why Do We Use Data Collection Tools?

SuTasty & ENC employs the following sorts of Data Collection Tools for the purposes outlined:

We use your data to provide our Services, communicate with you, troubleshoot issues, prevent fraud and abuse, improve and update our Services, analyze user behavior, serve personalized advertising, and comply with laws and regulations. We keep your data for as long as necessary to fulfill the objectives for which it was obtained.

  4. Push notifications are sent to your wireless device to give updates and other pertinent messages (which can be managed from the “options” or “settings” tab of the mobile app);

  • Facilitate the Services’ technical operation, including troubleshooting and resolving difficulties, safeguarding the Services, and avoiding fraud and abuse (All Data Categories);

  • Use Account, Learning, Sweepstakes, Usage, and Cookie Data to market products, services, surveys, and promotions. Also, use Account, Learning, and Cookie Data to promote subscription plans to prospective consumers;
  • Learn more about yourself by connecting your data to additional data through third-party data providers and/or analyzing the data with the help of analytics service providers (All Data Categories);
  • Utilize Account, System, and Cookie Data to identify unique users across devices and tailor adverts accordingly;

  • Analyze trends and traffic, track purchases, and monitor usage data (All Data Categories);
  • The Services may be advertised on third-party websites and applications (All Data Categories), as required by law (all data categories), or as necessary to protect users, employees, third parties, the public, or our Services (all data categories).

Who We Share Your Data With

We share certain information about you with the instructor, companies that provide services for us, SuTasty & ENC affiliates, our business partners, analytics and data enrichment providers, your social media providers, companies that assist us in running promotions and surveys, and advertising companies that help us promote our Services. We may also share your information as required for security, regulatory compliance, or organizational restructuring. Finally, we may disclose data in other ways if it is aggregated or de-identified, or if we obtain your consent.
We may share your data with other parties under the following conditions, or as otherwise specified in this Privacy Policy:
  • With Your Instructor: We share information we have about you (except your email address) with instructor or teaching assistants for educational content you access or request information on, so they can enhance it for you and other students. This data may include your country, browser language, operating system, device settings, the website that directed you to SuTasty & ENC, and specific SuTasty & ENC activities such as course enrollment and review. We will not provide your email address to teachers or teaching assistants. (All Data Categories);
  • For Service Providers, Contractors, and Agents: We share your information with third-party organizations who provide services on our behalf, such as payment processing, fraud and abuse prevention, data analysis, marketing and advertising (including retargeted advertising), email and hosting, and customer care and support. These service providers may have access to your personal information and are expected to use it only as directed by us to provide the service you have requested. (All Data Categories);
  • SuTasty & ENC Affiliates: We may share your data with entities in our corporate family that are related by shared ownership or control in order to enable or support the provision of the Services. (All Data Categories);

  • With Credit-Granting Organizations for Continuing Education: If you take a course to meet a continuing professional education requirement, we may share such information with the organization that provides the continuing education credit. (All Data Categories);
  • To Power Social Media Features: Some social media features in the Services (such as the Facebook Like button) may allow a third-party social media provider to gather information such as your IP address and the page of the Services you’re viewing, as well as set a cookie to enable the feature.   • To Administer Promotions and Surveys: We may share your data as needed to administer, market, or sponsor promotions and surveys in which you choose to participate, as required by applicable law (for example, providing a winners list or making required filings), or in accordance with the promotion or survey rules.   • For Advertising: If we decide to adopt an advertising-supported revenue model in the future, we may use and share specific System Data and Usage Data with third-party advertisers and networks in order to display general demographic and preference information about our users. We may also allow advertisers to acquire System Data using Data Collection Tools and utilize this data to provide you with targeted ad delivery, tailor your user experience (via behavioral advertising), and perform web analytics.   • For Security and Legal Compliance: We may release your data (all data categories) to third parties if we (in our sole discretion) believe that the disclosure is:

Security

We apply appropriate security measures based on the kind and sensitivity of the data we hold. As with any internet-enabled system, there is always the possibility of illegal access, so secure your password and notify us if you suspect any unauthorized access to your account.
SuTasty & ENC employs suitable security measures to prevent unauthorized access, alteration, disclosure, or destruction of the personal data we collect and retain. These measures vary according to the nature and sensitivity of the data. Unfortunately, no system can be completely secure, thus we cannot guarantee that interactions between you and SuTasty & ENC, the Services, or any information you supply to us in conjunction with the data we collect through the Services will be free of unauthorized access by third parties. Your password is a crucial element of our security system, and it is your duty to keep it secure. You should not disclose your password with anybody, and if you suspect your password or account has been compromised, change it right away and contact our Support Team if you have any questions.

Your Rights

You have some data protection rights, such as the opportunity to opt out of advertising communications, cookies, and third-party data collecting. You can amend or cancel your account through our Services, and you can also contact us with individual rights requests regarding your personal data. Please keep in mind that even after your account is terminated, some or all of your data may still be visible to others, including but not limited to data that has been (a) copied, stored, or disseminated by other users (including comments on content); (b) shared or disseminated by you or others (including in your shared content); or (c) posted to a third-party platform. Even if your account is canceled, we keep your information for as long as we have a reasonable reason to do so (and in accordance with relevant law), such as to comply with legal requirements, settle disputes, and enforce our agreements. We may store and disclose such data in accordance with this Privacy Policy after your account has been deleted.
  • Please use the online form provided here to request access, correction, or deletion of your personal data. You can also make these requests by emailing _enc@enutrition.me____. Please allow up to thirty business days for a response. For your protection, we may require that the request be sent from the email address connected with your account, and we may need to verify your identity before carrying out your request. Please keep in mind that we maintain certain data only when there is a legal reason to do so, such as for mandatory record-keeping and transaction completion.

3. Our Policy Concerning Children:

We respect children’s privacy interests and urge parents and guardians to be actively involved in their children’s online activities and interests. Individuals under the age of 18 who are of the required age for consent to use online services where they live (for example, 13 in the United States or 16 in Ireland) may not create an account, but may have a parent or guardian open an account and assist them in accessing appropriate content. Individuals under the minimum age for consent to use online services may not use the Services. If we discover that we have obtained personal information from a child under those age limits, we will take reasonable efforts to erase it.

Jurisdiction-Specific Rules

If you live in California, you have specific rights to access and delete your data, as well as learn about who we share it with. If you live in Australia, you have the right to file a formal complaint with the relevant government agency.   • “Right to Opt-Out” – You have the right not to have your personal information sold or shared.
The CCPA defines “sale” and “sharing,” and while SuTasty & ENC does not sell your personal information or any of our users’ personal information in the traditional sense, we do use cookies that make non-personally identifiable information available to select third parties, including for cross-context advertising. To opt out of such a “sale” and “sharing,” click the “Do Not Sell or Share My Personal Information” link at the bottom of the page.
To exercise any of your CCPA rights, please contact _enc@enutrition.me____. The CCPA allows you to appoint an authorized agent to make these requests on your behalf. To safeguard you, we may require that the request be sent from the email address connected with your account, and we may need to authenticate your and/or your agent’s identities before fulfilling your request. Furthermore, for more information on the personal information we gather and how we obtain it, please see the parts above headed “Data We Collect” and “How We Collect Data About You.”
To understand more about the business and commercial purposes for which your personal information is gathered, as well as the types of service providers who have access to it, please see the sections above headed “How We Use Your Data” and “Who We Share Your Data With.”
As a California resident, you have the right to seek specific information regarding the personal information we disclose with third parties for their direct marketing purposes. Because there is no widely acknowledged standard for the browser-initiated Do Not Track signal, we do not yet recognize or respond to them.

2. Users in Nevada:

SuTasty & ENC does not sell users’ personal information or data. Nonetheless, Nevada residents have the right to request that we not sell their covered personal information by contacting enc@enutrition.me .

3. Users in Australia:

If you are an Australian resident and have a complaint, you can file it with the Australian Information Commissioner (“OAIC”). You can contact OAIC by going to www.oaic.gov.au, sending an email to enquiries@oaic.gov.au, calling 1300 363 992, or mailing to ___________________. You can contact our privacy team at ______________________ to file a complaint about an infringement of the Australian Privacy Principles, which will be addressed within 30 days.

4. Users in the European Economic Area (“EEA”) and United Kingdom (“UK”):

If you live in the European Economic Area or the United Kingdom, you have the right to seek access to your data in a portable format, as well as the rectification, erasure, restriction of processing, or objection to processing of your personal data. You may submit your request using the information provided in Section 6.2. Furthermore, if you are in the EEA, the UK, or Switzerland, you have the right to file a complaint with your supervisory authority.
Personal data is also handled outside of the UK, Switzerland, and the EEA by our SuTasty & ENC group companies or service partners, including for transaction processing, payment facilitation, and support services as mentioned in Section 4. We use the European Commission’s Controller-to-Processor Standard Contractual Clauses to facilitate personal data transfers from the EEA to third countries, and we have entered into data processing agreements with our service providers and SuTasty & ENC group companies to limit and regulate their processing of your data. By submitting your data or using our Services, you agree to this transfer, storage, and processing by SuTasty & ENC and its processors.

5. Data Privacy Framework (for EU/EEA, UK, and Swiss data subjects):

SuTasty & ENC, Inc. adheres to the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as established by the US Department of Commerce. SuTasty & ENC, Inc. has certified to the U.S. Department of Commerce that it follows the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) for the processing of personal data received from the European Union under the EU-U.S. DPF and from the United Kingdom (and Gibraltar) under the UK Extension to the EU-U.S. DPF. SuTasty & ENC, Inc. has certified to the United States Department of Commerce that it follows the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) while processing personal data received from Switzerland in accordance with the Swiss-U.S. DPF. If there is a discrepancy between the terms of this Privacy Policy and the EU-US DPF Principles and/or the Swiss-US DPF Principles, the Principles will prevail.
